The High Court has halted the government’s plan to privatise the Kenya Pipeline Company (KPC) following a petition by the Consumers Federation of Kenya (COFEK).
Justice Bahati Mwamuye on Friday, August 15, 2025, issued a conservatory order barring the sale, transfer, or any dealings with KPC shares until the case is determined.
The judge directed COFEK to serve the application, petition, and court order to the respondents and all interested parties by close of business today and file proof of service. The respondents have until August 22 to file their responses, while COFEK may submit a rejoinder by August 29.
The case will be heard in open court on September 5, 2025, at 10:00 a.m.
The Cabinet had on July 29 approved the inclusion of KPC in the privatisation programme, signalling plans for partial share divestiture and listing on the Nairobi Securities Exchange. However, the latest order temporarily freezes the process pending the court’s decision.
