COURT ISSUES DIRECTIVES IN NDIANG’UI KINYAGIA’S CASE

The High Court has barred police from arresting or detaining missing activist and lawyer Ndiang’ui Kinyagia until further notice, following his dramatic appearance in court after days of public concern over his whereabouts.
Justice Bahati Mwamuye today, Thursday July 3rd, 2025 ruled that Kinyagia should not be apprehended by officers from the Directorate of Criminal Investigations (DCI) or the National Police Service pending two crucial court sessions set for July 18, 2025 and July 24,2025.
Kinyagia resurfaced at the Milimani Law Courts in the company of his lawyers, including prominent political figure Martha Karua and advocate Wahome Thuku. He told the court that he had gone into hiding after learning he was being sought by DCI officers over alleged inflammatory social media posts related to the June 25 Gen Z protests.
“I feared for my life,” Kinyagia stated. “I only came out now because the court is the only place I believe can guarantee my safety.”
Justice Mwamuye’s ruling follows an earlier order by Justice Chacha Mwita on June 30, compelling DCI boss Mohamed Amin to appear in court and explain the blogger’s disappearance. The judge also ordered the Inspector General of Police, Japhet Koome, to produce Kinyagia in court or provide a convincing explanation of his location.
The court will reconvene later this month to determine whether Kinyagia should face any legal action and under what conditions.
The case has drawn national attention, raising concerns about the safety of online activists and the alleged abuse of police power in silencing dissent.
