TRUMP ORDERS AMERICAN FLAG BURNERS TO BE ARRESTED IMMEDIATELY

United States President Donald Trump has announced that anyone caught burning the American flag “will be immediately arrested” and face a one-year prison sentence in a message to the U.S. Immigration and Customs Enforcement (ICE), Customs and Border Protection, and the military.
The US President referenced his August 25, 2025, executive order on flag desecration. “To ICE, Border Patrol, Law Enforcement, and all U.S. Military: As per my August 25, 2025, Executive Order, please be advised that, from this point forward, anybody burning the American Flag will be subject to one year in prison,” Trump wrote on Truth Social Friday, October 3, evening. “You will be immediately arrested. Thank you for your attention to this matter!”
Although Trump’s announcement suggests strict criminal penalties, the executive order itself does not create new laws or penalties. Instead, it directs the Department of Justice to enforce existing federal, state, and local laws related to flag desecration “to the maximum extent permitted by the Constitution.”
The executive order emphasizes the symbolic importance of the flag, calling it “the most sacred and cherished symbol of the United States of America, and of American freedom, identity, and strength.” It states that burning the flag is “a statement of contempt, hostility, and violence against our Nation” that may “incite violence and riot.”
“The American Flag is a special symbol in our national life that should unite and represent all Americans of every background and walk of life. Desecrating it is uniquely offensive and provocative. It is a statement of contempt, hostility, and violence against our Nation — the clearest possible expression of opposition to the political union that preserves our rights, liberty, and security,” the executive order reads.
“Burning this representation of America may incite violence and riot. American Flag burning is also used by groups of foreign nationals as a calculated act to intimidate and threaten violence against Americans because of their nationality and place of birth.”
